Terms & Conditions

1. Definitions

“Service” means the SMS marketing and automation system provided by TaNik Marketing System.

“Client” means the business or individual using the Service.

“Recipient” means the person receiving SMS messages sent through the Client’s account.

2. Client Obligations

The Client is fully responsible for all SMS content sent via the Service.

The Client must obtain valid opt-in consent from Recipients before sending marketing messages.

Each SMS must include a clear opt-out option (e.g., “Reply STOP to unsubscribe”).

The Client must not send:
Fraudulent, misleading, or unlawful content. Unsolicited spam messages or bulk messages without consent. Content that breaches Australian laws.

3. Provider Responsibilities

The Provider supplies the SMS platform and technical support within the scope of the Service.

The Provider does not edit, monitor, or take responsibility for the Client’s SMS content.

The Provider reserves the right to suspend or terminate accounts that breach these Terms or Australian

4. Legal Compliance

The Service complies with the Spam Act 2003, Privacy Act 1988, and related Australian legislation.

The Client agrees to comply with these laws when using the Service.

5. Limitation of Liability

The Provider is not liable for:
SMS delivery failures or blocks by carriers. Complaints or penalties arising from the Client’s misuse (e.g., spam).

Maximum liability is limited to the Service fees paid by the Client in the last billing month.

6. Fees & Refunds

All fees are payable in advance and are non-refundable (unless required by law).

SMS pricing may vary based on carrier costs; Clients will be notified of changes

7. Termination

The Provider may terminate accounts immediately for breaches of law or these Terms.

The Client may cancel at any time, but prepaid fees are non-refundable.

8. Governing Law

These Terms are governed by the laws of Australia.

If any clause is found invalid, the remaining clauses remain enforceable.

By using the Service, the Client agrees to these Terms & Conditions.
